Back in 2011, Apple and Samsung were in courts for the violation of laws regarding copyright acts and patent features. The case was won by Apple and Samsung had to pay a huge fortune as a penalty which the company succeeded in paying. The litigation battles between the companies have not been something new and there have been subsequent hearings in different years regarding the issue of copying each other’s designs or illegally utilizing the intellectual property of each other.
The companies have once again knocked the court’s door and the matter has been brought before judges to examine the claim that the amount of penalty that Apple received exceeded the logical parameters and paradigms of the violation. Yesterday, on Sunday, the court gave a ruling that a new trial must be set up so that the penalty amount of existing $399 million paid by Samsung is justified and fair or not. The courts have also obligated both the entities, Samsung and Apple, to recommend a date for a new trial on Wednesday.
For the past year, Samsung has been appealing in the Appeals court for a re-trial or re-examination of the violation of design patents of Apple which costed Samsung a humungous amount in the form of penalty. The lawyers and public has been raising questions regarding the amount that Samsung will have to pay Apple, will the former company pay all the revenues it has ever made with the sales of its products or just an allocated percentage of profits because the lawsuit is regarding the violation of patents pertinent to the design of iPhone and design is though significant but not the only component of a smartphone.
It will be interesting to see how both the tech giants deal with this bedlam because this involves money and reputation.
